Direct Access Barrister

Marcia Duncan-Brown

I am a specialist employment barrister and started over 25 years ago in HR when I first began advising on employment law. I advise and represent at Tribunal in a range of employment matters such as TUPE, whistle-blowing, discrimination and unfair dismissal, including direct discrimination, harassment and victimisation.

I have a diverse background with a career which began in Human Resource Management. I have worked in-house as an employment lawyer and was previously at the Bar now returning as a specialist in employment law. (Some time was spent in Criminal and Civil practice at the Bar).

I undertake both respondent and claimant work and can assist without the need of a solicitor advising on Tribunal orders and directions.

What sort of work do I do?

My experience covers preparation for and appearances at Case Management/Preliminary Hearings and Final Hearings (trial) of varying complexity and from single to multi-day hearings. I have conducted preparation for multi-type claims such as whistle-blowing, disability, race, sex discrimination, TUPE and unfair dismissal. I have also appeared in hearings covering complex discrimination and unfair dismissal cases.

My experience has also entailed drafting advices, defences (ET3s), advising and delivering training to organisations including to HR practitioners on a range of employment issues over the years. I have also acted for both respondents and claimants although latterly the former in recent years.

Who do I work for?

My clients range from individuals to SMEs and household name companies and includes HR practitioners. I have worked in private companies, local authorities and conglomerates organisations.
