Employment and Pensions Gareth acts for both employers and employees in all aspects of employment work, frequently appearing in the employment and employment appeal tribunals.
He provides a complete advisory service, recent examples including advising on grievances and application of conduct policies, drafting settlement agreements, advising as to occupational pension schemes and rights under public sector final salary schemes as well as offering investigatory services as an accredited investigator.
For cases which were litigated, some recent examples of my work include:
Automatic unfair dismissal claims, including recent claims regarding health and safety during Covid 19;
Constructive dismissal complaints arising out of alleged breaches of the implied duty of mutual trust and confidence
Indirect age and sex discrimination, leading to a 5 day Tribunal hearing
Negotiated settlement following allegations of sexual harassment, resulting in termination of accused perpetrator
Settlement of disability discrimination claim on behalf of employee who consumed illicit drugs during work
Acting for claimant in claim involving care home staff subject to BBC panorama investigation and reports of abuse
Successful pursuit of multi-million pound action against ex-employees for national transport employer
What sort of work do I do?
I act in all types of employment law matters. In particular, I specialise in claims involving unfair dismissal, discrimination and whistleblowing. I regularly advise employees on their rights and entitlements when in dispute or grievance with their employers. This includes advising employees who may feel unfairly treated at work and considering having to resign. Should claims have to be brought, I draft the claim forms and then act throughout the litigation if necessary. Should employees seek to negotiate settlements, I regularly advise on these and can negotiate with an employer to that end. I also have a particular practice advising clients as to non-compete clauses and their post-employment rights.
Who do I work for?
I act for both employees and employers and by doing so benefit from understanding and anticipating the likely interests, tactics and positions of both sides.
For employees, recent examples include GMB Union members, postal workers, teachers, C-suite level directors and employee shareholders, local government employees and outsourced workers.
For employers, recent examples include NHS Trusts, blue-chip companies and county councils.
