Faye Amelia Rolfe

Faye is a criminal and regulatory barrister practicing from the award-winning Red Lion Chambers. She is able to provide advice and representation at every stage of a case, from pre-charge through to trial, sentence and appeal.

Faye graduated from the University of Cambridge with a degree in Natural Sciences before working in the pharmaceutical sector and then making her career at the Bar. She provides a professional and approachable service to clients facing the full range of criminal cases and linked civil matters including asset recovery, banning/ protection orders and road traffic cases. Faye also represents professionals facing proceedings before their regulator, with particular expertise in healthcare, being a GMC Panel Advocate and having conducted many cases before the NMC. Faye's experience is drawn from both defending and prosecuting, and is sought after for both advocacy and written tactical advice.

Area of Law

Asset Recovery

Faye is able to assist clients in forfeiture matters or in the recovery of frozen assets from law enforcement. She can also provide advice on matters brought under the proceeds of crime legislation and in cases involving Unexplained Wealth Orders. Faye has successfully represented clients facing applications brought under s22 POCA 2022 for variation of the available amount, and is able to leverage the experience gained from advising law enforcement on challenges to their orders.

Crime

Faye has extensive experience across the range of cases before the criminal courts, and has successfully defended individuals facing allegations of financial wrongdoing, violence, sexual offending and driving offences. Faye also acts for the Crown Prosecution service and has been instructed in lengthy trials concerning serious organised crime, money laundering and attempted murder thereby providing her with the tactical insight into prosecutions faced by defendants.

Fraud

Faye has experience of successfully defending in cases of fraud and money laundering, and brings a wealth of tactical inside knowledge from her experience from prosecuting those offences as well. Faye has been part of defence teams undertaking large-scale disclosure review exercises in prosecutions by the Serious Fraud Office (SFO), civil disputes and Internal Investigations. Faye has given seminars on Overseas Production Orders, and civil recovery under Part 5 POCA, including Unexplained Wealth Orders, Freezing orders, Account Freezing Orders and Recovery Orders.

Health and Safety, including Product Liability

Faye has advised clients in the pharmaceutical sector in relation to allegations of contamination of their product, in an investigation that began as one into corporate manslaughter. Her scientific background and experience of the sector enabled Faye to bridge the gap between the client and lawyers - advising on how best to respond to technical questions posed during pre-charge negotiations, providing templates for quantitative risk assessments and prose explanations that translated the client's technical responses into a form that was persuasive for the prosecuting authorities.

Faye has appeared as an advocate in relation to professional discipline matters before healthcare regulators including the GMC, NMC and others. Before becoming a barrister Faye studied Natural Sciences (Biological and Medical Sciences) at the University of Cambridge, and is therefore particularly well-placed to assist in cases where expert scientific evidence is to be challenged. Faye has also represented medical professionals at inquests into the death of patients for whom they cared, and families wishing to ensure the full facts of their loved-one's death is explored.
