Mediation is generally much cheaper than going to court because you are 'sharing' the cost and in most cases there is no delay in getting started. Unlike the legal process, it is 'non-adversarial' so matters are unlikely to be made any worse by the process. If a solution is not reached it is often the case that the issues will have been narrowed and any legal proceedings that do follow will be shorter and cheaper. Mediation is fully recognised by the court; indeed, there is an expectation that before applying to the Family Court you will need to prove that you have considered mediation first.

Mediation has the further advantage of being conducted ‘without prejudice’. Participants can speak their minds as nothing said is admissible in court should the mediation fail. If you achieve a solution in mediation you are more likely to stay on reasonable terms with your former partner; something especially important where children are involved.

But mediation is not purely for family matters. Qualified mediators cover a broad spectrum of disputes, including employment and the workplace, neighbourhood and commercial disputes; in fact, mediation is available for every conceivable conflict in personal and commercial life.
